The proposed class action settlement described in the Class Notice and in this web-site was given final approval by the two Courts presiding over the settlement approval process.  The period to submit claims is still open, and is presently scheduled to close June 20, 2008.  Please read your Class Notice and the information provided in this web-site carefully regarding your claim submission.  The Final Order and Judgment Approving Class Action Settlement and Dismissing Class Action With Prejudice entered by each Court may be accessed by clinking on the links below:

           

Final Order and Judgment Approving Class Action Settlement and Dismissing Class Action With Prejudice, entered March 6, 2008, by the District Court of Nueces County, Texas in Yolanda Garza v. Nationwide Mutual Insurance Company et al., Cause No. 02-06322-E.

           

Final Order and Judgment Approving Class Action Settlement and Dismissing Class Action With Prejudice, entered on March 17, 2008, by the United States District Court for the District of Arizona in as Macaela Cashman v. Allied Insurance, et al., Case No. CIV-05-415-TUC-RCC.

A proposed class action settlement has been reached, and preliminarily approved by the presiding Courts, that would resolve four class action lawsuits against affiliated companies often generally referred to as Nationwide Insurance or Allied Insurance. The Courts will hold fairness hearings as described in the Class Notice to consider final approval of the settlement as fair, reasonable, and adequate.

In the Lawsuits, the Plaintiffs allege that the Defendants improperly reduced or denied insurance benefits for medical or rehabilitative services after submitting medical bills to medical review vendors. Nationwide/Allied denies any wrongdoing, and contends that review of medical bills  protects against excessive charges and helps to preserve insurance benefits. The Courts have made no final rulings on the merits of the claims or defenses made in the Lawsuits.

A description of the Settlement Class, the companies included as “Nationwide/Allied”, and the terms of the settlement and release are available in the Class Notice posted on this site. Provider or Insured Claim Forms can be printed for submitting a settlement claim. You can also view the full Settlement Agreement, copies of pertinent Court orders and other court filings, and other information concerning the settlement and the Lawsuits. The settlement provides for monetary payments to Settlement Class Members upon timely submission of a valid Claim Form. You also have other options under the settlement as summarized below. PLEASE READ THE CLASS NOTICE CAREFULLY TO DETERMINE IF YOU ARE A SETTLEMENT CLASS MEMBER AND YOUR RIGHTS AND OPTIONS UNDER THE SETTLEMENT.
